One of the most disingenuous arguments in the aftermath of the NSA spying revelations is that the American people shouldn't be concerned about the government hoovering up its sensitive information because it's only metadata--or a fancy way of saying data about the data. "This is just metadata," Senate Intelligence Committee Chairwoman Dianne Feinstein assured the American people, referring to the NSA's bulk collection of Americans call records. "There is no content involved." President Obama and his national security officials have made similar assurances. Feel better? You shouldn't and here's why. A tool developed by MIT Media Lab proves how intrusive the collection and analysis of metadata is over time, especially for those who are overly reliant on email as their main method of communication. Dubbed "Immersion," the tool analyzes the metadata--From, To, Cc and Timestamp fields-- from a volunteer's Gmail account and visualizes it.

Two years ago, Nasser al-Awlaki wrote a letter to President Obama. His request was simple: Please do not kill my son. He never got a response. Last September, his son, Anwar al-Awlaki, an American-born al Qaeda leader, was killed by a U.S. drone in a remote area of Northern Yemen. Two weeks later, his 16-year-old grandson, Anwar’s son, was also killed, in a separate U.S. strike hundreds of miles away. “Anwar, it was expected, because he was … targeted,” Nasser al-Awlaki told CNN’s Christiane Amanpour in an exclusive interview on Wednesday. “But how in the world they will go and kill Abdulrahman, a small boy, a U.S. citizen, from Denver, Colorado?” Nasser’s son, Anwar, was born in New Mexico in 1971 while he was studying for his master’s degree. The family moved back to Yemen, but Anwar returned to the U.S. for college, and became an imam in California.

9/27/2010  Administration Seeks Easy Access To Americans' Private Online Communications: Executive Branch Spying Powers Already Too Broad, Says ACLU
The Obama administration is seeking to expand the government’s ability to conduct invasive surveillance online, according to a report in The New York Times today. According to the report, the administration is expected to submit legislation to Congress early next year that would mandate that all online communications services use technologies that would make it easier for the government to collect private communications and decode encrypted messages that Americans send over texting platforms, BlackBerries, social networking sites and other “peer to peer” communications software. The administration has argued that it is simply hoping to emulate the Communications Assistance to Law Enforcement Act (CALEA), which mandated that telephone companies rework their networks to be wiretap-ready. The administration’s proposal, however, differs from CALEA as it would require reconfiguring of the Internet to provide easier access to online communications. This is particularly problematic because many of the privacy protections that governed the government’s wiretapping powers when CALEA passed in 1994 no longer exist or have been significantly weakened.

And like any powerful institution in a democracy, they must be constructed in a carefully bounded and limited manner with sufficient checks and balances to prevent abuse.
