You Can Have Sex With Them; Just Don't Photograph Them: A former cop's 15-year prison sentence illustrates the absurdity of federal child porn laws. In the spring and summer of 2006, Eric Rinehart, at the time a 34-year-old police officer in the small town of Middletown, Indiana, began consensual sexual relationships with two young women, ages 16 and 17. One of the women had contacted Rinehart through his MySpace page. He had known the other one, the daughter of a man who was involved in training police officers, for most of her life. Rinehart was going through a divorce at the time. The relationships came to the attention of local authorities, and then federal authorities, when one of the girls mentioned it to a guidance counselor.
Whatever you might think of Rinehart's judgment or ethics, his relationships with the girls weren't illegal. The age of consent in Indiana is 16. That is also the age of consent in federal territories. Rinehart got into legal trouble because one of the girls mentioned to him that she had posed for sexually provocative photos for a previous boyfriend and offered to do the same for Rinehart. Rinehart lent her his camera, which she returned with the promised photos. Rinehart and both girls then took additional photos and at least one video, which he downloaded to his computer. (Reason)
DHS scoured social media sites during Obama inauguration for 'items of interest': EFF has released documents that reveal a broad range of targets, including Facebook and Twitter, as well as NPR and DailyKos An electronic rights advocacy group is expressing concern over what it contends was an overly broad surveillance of social networking sites conducted by the U.S. Department of Homeland Security in the days leading up to the 2009 inauguration of President Barack Obama.
The Electronic Frontier Foundation (EFF) recently obtained documents pertaining to the DHS's monitoring of social networking sites through a Freedom of Information Act (FOIA) lawsuit.
The documents show that the DHS established a unit called the Social Network Monitoring Center (SNMC) last year to scour social sites for signs of potential security threats during the presidential inauguration. (Computer World)
Defense launches online system to coordinate Haiti relief efforts On Monday, Jean Demay, DISA's technical manager for the agency's Transnational Information Sharing Cooperation project, happened to be at the headquarters of the U.S. Southern Command in Miami preparing for a test of the system in a scenario that involved providing relief to Haiti in the wake of a hurricane. After the earthquake hit on Tuesday, Demay said SOUTHCOM decided to go live with the system. (Technology And The Business of Government)
EXCLUSIVE: W.H. collects Web users' data without notice The White House is collecting and storing comments and videos placed on its social-networking sites such as Facebook, Twitter and YouTube without notifying or asking the consent of the site users, a failure that appears to run counter to President Obama's promise of a transparent government and his pledge to protect privacy on the Internet.
Marc Rotenberg, president of the Electronic Privacy Information Center, said the White House signaled that it would insist on open dealings with Internet users and, in fact, should feel obliged to disclose that it is collecting such information.
"The White House has not been adequately transparent, particularly on how it makes use of new social media techniques, such as this example," he said. (Washington Times)
Leaked Australian blacklist reveals banned sites The Australian communications regulator's top-secret blacklist of banned websites has been leaked on to the web and paints a harrowing picture of Australia's forthcoming internet censorship regime.
Wikileaks, an anonymous document repository for whistleblowers, obtained the list, which has been seen by this website, and plans to publish it for public consumption on its website imminently.
Wikileaks has previously published the blacklists for Thailand, Denmark and Norway.
University of Sydney associate professor Bjorn Landfeldt said the leaked list "constitutes a condensed encyclopedia of depravity and potentially very dangerous material".
He said the leaked list would become "the concerned parent's worst nightmare" as curious children would inevitably seek it out. (The Age)
NSA's Domestic Spying Grows As Agency Sweeps Up Data Five years ago, Congress killed an experimental Pentagon antiterrorism program meant to vacuum up electronic data about people in the U.S. to search for suspicious patterns. Opponents called it too broad an intrusion on Americans' privacy, even after the Sept. 11 terrorist attacks.
But the data-sifting effort didn't disappear. The National Security Agency, once confined to foreign surveillance, has been building essentially the same system.
The central role the NSA has come to occupy in domestic intelligence gathering has never been publicly disclosed. But an inquiry reveals that its efforts have evolved to reach more broadly into data about people's communications, travel and finances in the U.S. than the domestic surveillance programs brought to light since the 2001 terrorist attacks. Senator: Illegal images must be reported -- Millions of commercial Web sites and personal blogs would be required to report illegal images or videos posted by their users or pay fines of up to $300,000, if a new proposal in the U.S. Senate came into law. The legislation, drafted by Sen. John McCain and obtained by CNET News.com, would also require Web sites that offer user profiles to delete pages posted by sex offenders.
In a speech on the Senate floor Wednesday, the Arizona Republican and former presidential candidate warned that "technology has contributed to the greater distribution and availability, and, some believe, desire for child pornography." McCain scored 31 of 100 points on a News.com 2006 election guide scoring technology-related votes.
After child pornography or some forms of "obscenity" are found and reported, the Web site must retain any "information relating to the facts or circumstances" of the incident for at least six months. Webmasters would be immune from civil and criminal liability if they followed the specified procedures exactly.
McCain's proposal, called the "Stop the Online Exploitation of Our Children Act" (click for PDF), requires that reports be submitted to the National Center for Missing and Exploited Children, which in turn will forward them to the relevant police agency. Amateur 'video bloggers' under threat from EU broadcast rules THE Government is seeking to prevent an EU directive that could extend broadcasting regulations to the internet, hitting popular video-sharing websites such as YouTube.
The European Commission proposal would require websites and mobile phone services that feature video images to conform to standards laid down in Brussels.
Ministers fear that the directive would hit not only successful sites such as YouTube but also amateur “video bloggers” who post material on their own sites. Personal websites would have to be licensed as a “television-like service”.
Viviane Reding, the Media Commissioner, argues that the purpose is simply to set minimum standards on areas such as advertising, hate speech and the protection of children.
But Shaun Woodward, the Broadcasting Minister, described the draft proposal as catastrophic. He said: “Supposing you set up a website for your amateur rugby club, uploaded some images and added a link advertising your local sports shop. You would then be a supplier of moving images and need to be licensed and comply with the regulations.”
The draft rules, known as the Television Without Frontiers directive, extend the definition of broadcasting to cover services such as video-on-demand or mobile phone clips. (London Times)
US government funds social network snooping: Citizens under scrutiny The US government is funding research into social networking sites and how to gather and store personal data published on them, according to the New Scientist magazine.
At the same time, US lawmakers are attempting to force the social networking sites themselves to control the amount and kind of information that people, particularly children, can put on the sites. (The Register)
