2/9/2012 The Top Twelve Reasons Why You Should Hate the Mortgage Settlement
As readers may know by now, 49 of 50 states have agreed to join the so-called mortgage settlement, with Oklahoma the lone refusenik. Although the fine points are still being hammered out, various news outlets (New York Times, Financial Times, Wall Street Journal) have details, with Dave Dayen’s overview at Firedoglake the best thus far. The Wall Street Journal is also reporting that the SEC is about to launch some securities litigation against major banks. Since the statue of limitations has already run out on securities filings more than five years old, this means they’ll clip the banks for some of the very last (and dreckiest) deals they shoved out the door before the subprime market gave up the ghost. The various news services are touting this pact at the biggest multi-state settlement since the tobacco deal in 1998. While narrowly accurate, this deal is bush league by comparison even though the underlying abuses in both cases have had devastating consequences. The tobacco agreement was pegged as being worth nearly $250 billion over the first 25 years. Adjust that for inflation, and the disparity is even bigger. That shows you the difference in outcomes between a case where the prosecutors have solid evidence backing their charges, versus one where everyone know a lot of bad stuff happened, but no one has come close to marshaling the evidence.

2/8/2012 49-State Foreclosure Fraud Settlement Will Be Finalized Thursday
Forty-nine states, every one but Oklahoma, as well as federal regulators will participate in a foreclosure fraud settlement that will release the five biggest banks (Wells Fargo, Citi, Ally/GMAC, JPMorgan Chase and Bank of America) and their mortgage servicing units from liability for robo-signing and other forms of servicer abuse, in exchange for $25 billion in funding for legal aid, refinancing, short sales, restitution for wrongful foreclosures and principal reduction for underwater borrowers. The announcement will be made on Thursday. This settlement arises from multiple abuses found in the servicing of loans and the foreclosure process over the past several years. At the height of the housing bubble, banks sliced and diced mortgages and traded them with little regard for the rules following land recording or securitization to such a sloppy extent that they lost track of the true owner on potentially millions of homes. To cover up for this massive failure, banks and their servicing units have been found to have routinely forged, back-dated and fabricated documents at county recorder offices and state courts across the country. Furthermore, they employed “robo-signers,” who signed hundreds of thousands (if not millions) of documents and affidavits without any knowledge of the underlying mortgages. In addition, investigations uncovered massive servicing abuses, including illegal fees charged to borrowers, putting borrowers into foreclosure at the same time as they were working out loan modifications, failing to honor previous settlements where promises were made on modifications, and countless other errors that maximized servicer profits and gouged homeowners. There are also cases of wrongful foreclosures where homeowners have been turned out of their homes without just cause, and servicer-driven foreclosures, where servicers illegally added late fees and applied payments inaccurately, pushing the homeowner into foreclosure. This is but a smattering of the examples of foreclosure fraud and servicer abuse found in a series of interlocking investigations, court depositions, reviews of documents in registers of deeds offices, and homeowner testimonials.

Changes in one precinct alone shifted the vote by 50 — a margin greater than the certified tally.

5/7/2011 Nuclear Agency Is Criticized as Too Close to Its Industry
In the fall of 2007, workers at the Byron nuclear power plant in Illinois were using a wire brush to clean a badly corroded steel pipe — one in a series that circulate cooling water to essential emergency equipment — when something unexpected happened: the brush poked through. The resulting leak caused a 12-day shutdown of the two reactors for repairs. The plant’s owner, the Exelon Corporation, had long known that corrosion was thinning most of these pipes. But rather than fix them, it repeatedly lowered the minimum thickness it deemed safe. By the time the pipe broke, Exelon had declared that pipe walls just three-hundredths of an inch thick — less than one-tenth the original minimum thickness — would be good enough. Though no radioactive material was released, safety experts say that if enough pipes had ruptured during a reactor accident, the result could easily have been a nuclear catastrophe at a plant just 100 miles west of Chicago. Exelon’s risky decisions occurred under the noses of on-site inspectors from the federal Nuclear Regulatory Commission. No documented inspection of the pipes was made by anyone from the N.R.C. for at least the eight years preceding the leak, and the agency also failed to notice that Exelon kept lowering the acceptable standard, according to a subsequent investigation by the commission’s inspector general.

4/9/2011 Radiation Detected In Drinking Water In 13 More US Cities, Cesium-137 In Vermont Milk
• Unusual Reading At Chatanooga Nuclear Plant • Milk Contamination At EPA Maximum • Highest Levels Yet In Boise Rainwater Radiation from Japan has been detected in drinking water in 13 more American cities, and cesium-137 has been found in American milk—in Montpelier, Vermont—for the first time since the Japan nuclear disaster began, according to data released by the Environmental Protection Agency late Friday. Milk samples from Phoenix and Los Angeles contained iodine-131 at levels roughly equal to the maximum contaminant level permitted by EPA, the data shows. The Phoenix sample contained 3.2 picoCuries per liter of iodine-131. The Los Angeles sample contained 2.9. The EPA maximum contaminant level is 3.0, but this is a conservative standard designed to minimize exposure over a lifetime, so EPA does not consider these levels to pose a health threat. The cesium-137 found in milk in Vermont is the first cesium detected in milk since the Fukushima-Daichi nuclear accident occurred last month. The sample contained 1.9 picoCuries per liter of cesium-137, which falls under the same 3.0 standard. Radioactive isotopes accumulate in milk after they spread through the atmosphere, fall to earth in rain or dust, and settle on vegetation, where they are ingested by grazing cattle. Iodine-131 is known to accumulate in the thyroid gland, where it can cause cancer and other thyroid diseases. Cesium-137 accumulates in the body’s soft tissues, where it increases risk of cancer, according to EPA.

4/5/2011 How The 'Pox' Epidemic Changed Vaccination Rules
Historian Michael Willrich was planning to write a book about civil liberties in the aftermath of Sept. 11 when he stumbled across an article from The New York Times archives. It was about a 1901 smallpox vaccination raid in New York — when 250 men arrived at a Little Italy tenement house in the middle of the night and set about vaccinating everyone they could find. "There were scenes of policemen holding down men in their night robes while vaccinators began their work on their arms," Willrich tells Fresh Air's Terry Gross. "Inspectors were going room to room looking for children with smallpox. And when they found them, they were literally tearing babes from their mothers' arms to take them to the city pesthouse [which housed smallpox victims.]" The vaccination raid was not an isolated incident. As the smallpox epidemic swept across the country, New York and Boston policemen conducted several raids and health officials across the country ordered mandatory vaccinations in schools, factories and on railroads. In Pox: An American History, Willrich details how the smallpox epidemic of 1898-1904 had far-reaching implications for public health officials — as well as Americans concerned about their own civil liberties.

Despite media hype about the radiation dangers, the Fukushima nuclear crisis won't end like Chernobyl, Alexander Sich tells The Diplomat. Is the kind of massive radiation release that occurred with Chernobyl possible at the Fukushima plant? No, it can’t have that kind of massive release. It simply can’t do that. The question is to what extent the zirconium alloy, which clads the fuel pellets, is damaged in the core, and how much of the fuel has failed. And I don’t necessarily mean melted, I mean failed. There’s been an ambiguous use of the word ‘melting’ applied to the core. But when people talk about meltdown, they should be very specific about what they mean by the word.

3/28/2011 EPA to Help Mainstream Media Obscure The Truth About Radiation Exposure to Americans
As Americans focus on March Madness and Dancing With the Stars instead of the radioactive plume spreading all across the country, the US EPA (Environmental Protection Agency) is attempting to make the mainstream media cover up of the Fukushima cloud a bit easier. The agency now notorious for its infamous claim that the air was safe to breathe after 9/11 is now seeking to raise the PAGs (Protective Action Guides) to levels vastly higher than those at which they are currently set allowing for more radioactive contamination of the environment and the general public in the event of a radioactive disaster. PAGs are policies established by the EPA that guide the agency in enforcing the various environmental laws such as the Clean Air and Water Act in the invent of a radioactive emergency such as a nuclear/dirty bomb or factory meltdown like that occurring in Japan. The EPA had already established PAGs in this area in 1992. They can be found here. However, the agency now plans to amend and revise these standards this year. Because regulatory agencies form their own policies (although they can be directed by either the President or the Congress), there is no requirement to seek Congressional approval for these changes. All that is required is that the agency place the proposed changes in the Federal Register for public comment before it finalizes its draft into legal policy. According to PEER (Public Employees for Environmental Responsibility, the new standards would drastically raise the levels of radiation allowed in food, water, air, and the general environment. PEER, a national organization of local, state, and federal employees who had access to internal EPA emails, claims that the new standards will result in a “nearly 1000-fold increase for exposure to strontium-90, a 3000 to 100,000-fold hike for exposure to iodine-131; and an almost 25,000 rise for exposure to radioactive nickel-63” in drinking water. This information, as well as the emails themselves were published by Collapsenet on March 24.

8/24/2010 Full-Body Scan Technology Deployed In Street-Roving Vans
s the privacy controversy around full-body security scans begins to simmer, it’s worth noting that courthouses and airport security checkpoints aren’t the only places where backscatter x-ray vision is being deployed. The same technology, capable of seeing through clothes and walls, has also been rolling out on U.S. streets. American Science & Engineering, a company based in Billerica, Massachusetts, has sold U.S. and foreign government agencies more than 500 backscatter x-ray scanners mounted in vans that can be driven past neighboring vehicles to see their contents, Joe Reiss, a vice president of marketing at the company told me in an interview. While the biggest buyer of AS&E’s machines over the last seven years has been the Department of Defense operations in Afghanistan and Iraq, Reiss says law enforcement agencies have also deployed the vans to search for vehicle-based bombs in the U.S. “This product is now the largest selling cargo and vehicle inspection system ever,” says Reiss.

Congress has passed the Wall Street Reform and Consumer Protection Act, but the task of transforming our economy into one of shared and sustainable prosperity has only just begun. Structural reform will come not through the sweep of a single piece of legislation but with new, innovative economic models that better reflect the democratic values of this country. The good news is that some of these transformative ideas are already taking root. Here are five ways to build a more just economy that Americans are experimenting with across the country. The answer is 'B' Corporations are compelled to pursue a single objective: maximize profit. In fact, a company can be sued for following goals that veer from that statutory obligation. That's why Maryland State Sen. Jamie Raskin sponsored the Benefit Corporation legislation that was signed into law this spring. It gives businesses the option to register as a "B corporation," an entity legally obligated to maximize both shareholder value and advance a common public purpose such as cleaner air, open space or affordable housing. The B corporation's stated public goal is vigorously monitored by independent, third-party groups. It's a new business model with social consciousness in its DNA. B corporation legislation has also been passed in Vermont, and it is being considered in New York, Pennsylvania, New Jersey, Oregon, Washington and Colorado.

A nearly 25-year study concluded that children raised in lesbian households were psychologically well-adjusted and had fewer behavioral problems than their peers. The study, published Monday in the journal Pediatrics, followed 78 lesbian couples who conceived through sperm donations and assessed their children's well-being through a series of questionnaires and interviews.

2/19/2009 EPA expected to act in regulating carbon dioxide
The Environmental Protection Agency is expected to act for the first time to regulate carbon dioxide and other greenhouse gases that scientists blame for the warming of the planet, according to top Obama administration officials. The decision, which most likely would play out in stages over a period of months, would have a profound impact on transportation, manufacturing costs and how utilities generate power. It could accelerate the progress of energy and climate change legislation in Congress and form a basis for the United States' negotiating position at United Nations climate talks set for December in Copenhagen. The environmental agency is under order from the Supreme Court to make a determination whether carbon dioxide is a pollutant that endangers public health and welfare, an order that the Bush administration essentially ignored despite near-unanimous belief among agency experts that research points inexorably to such a finding. Lisa Jackson, the new EPA administrator, said in an interview that she had asked her staff to review the latest scientific evidence and prepare the documentation for a so-called endangerment finding. Jackson said she had not decided to issue such a finding but she pointedly noted that the second anniversary of the Supreme Court decision, Massachusetts v. EPA, is April 2, and there is the wide expectation that she will act by then. "We here know how momentous that decision could be," Jackson said. "We have to lay out a road map."

Even some who favor an aggressive approach to climate change said they were wary of the agency's asserting exclusive authority over carbon emissions. They say that the Clean Air Act, now more than 40 years old, was not designed to regulate ubiquitous substances like carbon dioxide. Using the law, they say, would capture carbon emissions from new facilities, but not existing ones, blunting its impact. They also believe that a broader approach that addresses all sectors of the economy and that is fully debated in Congress would be better than a regulatory approach that could drag through the courts for years.

12/1/2008 Pentagon Plans To Keep 20,000 Troops Inside US To Bolster Domestic Security
The U.S. military expects to have 20,000 uniformed troops inside the United States by 2011 trained to help state and local officials respond to a nuclear terrorist attack or other domestic catastrophe, according to Pentagon officials. The long-planned shift in the Defense Department's role in homeland security was recently backed with funding and troop commitments after years of prodding by Congress and outside experts, defense analysts said. There are critics of the change, in the military and among civil liberties groups and libertarians who express concern that the new homeland emphasis threatens to strain the military and possibly undermine the Posse Comitatus Act, a 130-year-old federal law restricting the military's role in domestic law enforcement. But the Bush administration and some in Congress have pushed for a heightened homeland military role since the middle of this decade, saying the greatest domestic threat is terrorists exploiting the proliferation of weapons of mass destruction.

Northern Edge 2007 will be to test crisis-response coordination between federally controlled military forces and National Guard units that come under the command of state governors, Peter F. The exercise, directed by the chairman of the Joint Chiefs of Staff, is slated to end May 18. In response to these challenges, a trinational, Independent Task Force on the Future of North America has developed a roadmap to promote North American security and advance the well-being of citizens of all three countries. When the leaders of Canada, Mexico, and the United States met in Texas recently they underscored the deep ties and shared principles of the three countries. The Council-sponsored Task Force applauds the announced "Security and Prosperity Partnership of North America," but proposes a more ambitious vision of a new community by 2010 and specific recommendations on how to achieve it. Pointing to increased competition from the European Union and rising economic powers such as India and China in the eleven years since NAFTA took effect, co-chair Pedro C. Aspe, former Finance Minister of Mexico, said, "We need a vision for North America to address the new challenges." The Task Force establishes a blueprint for a powerhouse North American trading area that allows for the seamless movement of goods, increased labor mobility, and energy security. "We are asking the leaders of the United States, Mexico, and Canada to be bold and adopt a vision of the future that is bigger than, and beyond, the immediate problems of the present," said co-chair John P. Manley, Former Canadian Deputy Prime Minister and Minister of Finance. "They could be the architects of a new community of North America, not mere custodians of the status quo."

Report of an Independent Task Force; Sponsored by the Council on Foreign Relations with the Canadian Council of Chief Executives and the Consejo Mexicano de Asuntos Internacionales

America’s relationship with its North American neighbors rarely gets the attention it warrants. This report of a Council-sponsored Indepen- dent Task Force on the Future of North America is intended to help address this policy gap. In the more than a decade since the North American Free Trade Agreement (NAFTA) took effect, ties among Canada, Mexico, and the United States have deepened dramatically. The value of trade within North America has more than doubled. Canada and Mexico are now the two largest exporters of oil, natural gas, and electricity to the United States. Since 9/11, we are not only one another’s major commercial partners, we are joined in an effort to make North America less vulnerable to terrorist attack. This report examines these and other changes that have taken place since NAFTA’s inception and makes recommendations to address the range of issues confronting North American policymakers today: greater economic competition from outside North America, uneven develop- ment within North America, the growing demand for energy, and threats to our borders. The Task Force offers a detailed and ambitious set of proposals that build on the recommendations adopted by the three governments at the Texas summit of March 2005. The Task Force’s central recommen- dation is establishment by 2010 of a North American economic and security community, the boundaries of which would be defined by a common external tariff and an outer security perimeter.

More than a decade ago NAFTA took effect, liberalizing trade and investment, providing crucial protection for intellectual property, creating pioneering dispute-resolution mechanisms, and establishing the first regional devices to safeguard labor and environmental standards. NAFTA helped unlock the region’s economic potential and demon- strated that nations at different levels of development can prosper from the opportunities created by reciprocal free trade arrangements. Since then, however, global commercial competition has grown more intense and international terrorism has emerged as a serious regional and global danger. Deepening ties among the three countries of North America promise continued benefits for Canada, Mexico, and the United States. That said, the trajectory toward a more integrated and prosperous North America is neither inevitable nor irreversible. In March 2005, the leaders of Canada, Mexico, and the United States adopted a Security and Prosperity Partnership of North America (SPP), establishing ministerial-level working groups to address key secu- rity and economic issues facing North America and setting a short deadline for reporting progress back to their governments. President Bush described the significance of the SPP as putting forward a common commitment ‘‘to markets and democracy, freedom and trade, and mutual prosperity and security.’’ The policy framework articulated by the three leaders is a significant commitment that will benefit from broad discussion and advice. The Task Force is pleased to provide specific advice on how the partnership can be pursued and realized. To that end, the Task Force proposes the creation by 2010 of a North American community to enhance security, prosperity, and opportunity. We propose a community based on the principle affirmed in the March 2005 Joint Statement of the three leaders that ‘‘our security and prosperity are mutually dependent and complementary.’’ Its boundaries will be defined by a common external tariff and an outer security perimeter within which the movement of people, products, and capital will be legal, orderly, and safe. Its goal will be to guarantee a free, secure, just, and prosperous North America.

A North American Advisory Council. To ensure a regular injection of creative energy into the various efforts related to North American integration, the three governments should appoint an independent body of advisers. This body should be composed of eminent persons from outside government, appointed to staggered multiyear terms to ensure their independence. Their mandate would be to engage in creative exploration of new ideas from a North American perspective and to provide a public voice for North America. A complementary approach would be to establish private bodies that would meet regularly or annually to buttress North American relationships, along the lines of the Bilderberg or Wehrkunde conferences, organized to support transatlantic relations.

10/17/2004 Faith, Certainty and the Presidency of George W. Bush
Bruce Bartlett, a domestic policy adviser to Ronald Reagan and a treasury official for the first President Bush, told me recently that ''if Bush wins, there will be a civil war in the Republican Party starting on Nov. 3.'' The nature of that conflict, as Bartlett sees it? Essentially, the same as the one raging across much of the world: a battle between modernists and fundamentalists, pragmatists and true believers, reason and religion. ''Just in the past few months,'' Bartlett said, ''I think a light has gone off for people who've spent time up close to Bush: that this instinct he's always talking about is this sort of weird, Messianic idea of what he thinks God has told him to do.'' Bartlett, a 53-year-old columnist and self-described libertarian Republican who has lately been a champion for traditional Republicans concerned about Bush's governance, went on to say: ''This is why George W. Bush is so clear-eyed about Al Qaeda and the Islamic fundamentalist enemy. He believes you have to kill them all. They can't be persuaded, that they're extremists, driven by a dark vision. He understands them, because he's just like them. . . . ''This is why he dispenses with people who confront him with inconvenient facts,'' Bartlett went on to say. ''He truly believes he's on a mission from God. Absolute faith like that overwhelms a need for analysis. The whole thing about faith is to believe things for which there is no empirical evidence.'' Bartlett paused, then said, ''But you can't run the world on faith.'' Forty democratic senators were gathered for a lunch in March just off the Senate floor. I was there as a guest speaker. Joe Biden was telling a story, a story about the president. ''I was in the Oval Office a few months after we swept into Baghdad,'' he began, ''and I was telling the president of my many concerns'' -- concerns about growing problems winning the peace, the explosive mix of Shiite and Sunni, the disbanding of the Iraqi Army and problems securing the oil fields. Bush, Biden recalled, just looked at him, unflappably sure that the United States was on the right course and that all was well. '''Mr. President,' I finally said, 'How can you be so sure when you know you don't know the facts?'''

Since the Tripod II biowarfare exercise was a joint New York-Department of Justice exercise we now must ask: Prior to 9/11, under US government Executive Branch procedure, what part of the government or official was responsible for and had the authority to coordinate and act as liaison between the military, federal agencies and state and local agencies and private corporations so that they did not overlap or interfere with each other, or occupy enough essential assets at one time to jeopardize operational readiness or impair the national security of the United States?

7/9/1999 THE POWER TO DESTROY; Is income tax legal? Evidence suggests; 16th Amendment never ratified
Evidence strongly suggests that the 16th Amendment, which establishes the income tax, was not approved properly as required by the Constitution and was fraudulently ratified. "If this evidence is true, the income tax is the greatest hoax ever perpetrated on the American people," says Robert L. Schulz. Schulz is head of We the People Foundation for Constitutional Education, Inc., a New York state-based organization that hosted a symposium in Washington last week on the topic, "Are the Income and Social Security Taxes Legal?" The foundation twice sent registered letters to President Clinton, Senate President Pro Tempore Trent Lott, and House Speaker Dennis Hastert, as well as the Internal Revenue Service, asking them to send representatives to the symposium who could explain the government's case for the legality of the income tax. They received no response, much less a speaker, but part of the conference was covered by C-SPAN and that resulted in hundreds of friendly responses from viewers. A key speaker at the symposium was William J. Benson, author of a two-volume investigative report on the ratification of the 16th Amendment entitled "The Law That Never Was."
