The Citizens United Effect: 40 percent of outside money made possible by Supreme Court ruling In 2002 former Defense Secretary Donald Rumsfeld once flippantly described connections between Saddam Hussein and Al Qaeda terrorists by saying, "There are known knowns; there are things we know that we know. There are known unknowns; that is to say, there are things that we now know we don’t know. But there are also unknown unknowns; there are things we do not know we don’t know." Little did Rumsfeld know that his remark would be the most accurate description for a murky midterm election eight years down the road.
The 2010 midterm election is filled with both "known unknowns," outside groups raised and spent $126 million on elections without disclosing the source, and "unknown unknowns," we don't know what those undisclosed donors want. We do know one thing: the Supreme Court's Citizens United ruling allowed this election to be the costliest and least transparent midterm in recent history.
The impact of Citizens United can be judged by simply following the money. The $126 million in undisclosed money represents more than a quarter of the total $450 million spent by outside groups. Add the $60 million spent by groups that were allowed to raise unlimited money, but still had to disclose, to the undisclosed money and the total amount of outside money made possible by the Citizens United ruling reaches $186 million or 40 percent of the total spent by outside groups. Campaign finance reform: R.I.P.? For four decades, advocates for stricter campaign finance rules have been on a long, slow march to make big money in politics less important and more transparent.
Now, in 2010, they are seeing the results: Never in modern political history has there been so much secret money gushing into an American election.
By Election Day, independent groups will have aired more than $200 million worth of campaign ads using cash that can’t be traced back to its original source, predicts Fred Wertheimer, president of the nonprofit group Democracy 21.
"And this is just the beginning," Wertheimer said. "Unless we get some changes here to mitigate this problem, I would expect we will see $500 million or more in 2012." (Politico)
DISCLOSE Act: House Passes Major Campaign Finance Legislation The final vote was 219 to 206 in favor of the DISCLOSE Act, with only two Republicans -- Rep. Mike Castle (R-Del.) and Joseph Cao (R-La.) -- crossing party lines. The bill would provide tough new disclosure rules for groups that invest in the election process. In addition to forcing all 501c4 groups to stand by the ads they sponsor during elections (with the CEO of the organization literally forced to appear in the spot), the law would also require groups that met certain criteria to reveal who was funding their election activity.
The latter provision sparked intense pushback from a host of business groups, led by the U.S. Chamber of Commerce. House Democratic leadership had granted an exemption from that particular element of disclosure for the NRA. But after fierce objection to the carve out, the bill's author, Rep. Chris Van Hollen (D-Md.), expanded the loophole to include other organizations as well.
The legislation was pulled from consideration late last week when passage became uncertain. House leadership made impassioned pleas to their colleagues on Thursday morning (see below) before heading to the floor this afternoon to finally vote. (Huffington Post)
Emanuel's War Plan for Democrats: The Book of Rahm Last week in CounterPunch (1), I wrote that the chair of the Democratic Congressional Campaign Committee (DCCC), Congressman Rahm Emanuel, had worked hard to guarantee that Democratic candidates in key toss-up House races were pro-war. In this he was largely successful, because of the money he commands and the celebrity politicians who reliably respond to his call, ensuring that 20 of the 22 Democratic candidates in these districts are pro-war. So the fix is in for the coming elections.
"A New Strategy to Win the War on Terror"
("War on Terror," as George Soros points out, is a false metaphor used by those who would drag us into military adventures not in our interest or that of humanity.)
"We need to use all the roots of American power to make our country safe. (He begins by playing on fear.) America must lead the world's fight against the spread of evil and totalitarianism, but we must stop trying to win that battle on our own. (Messianic imperialism.) We should reform and strengthen multilateral institutions for the twenty-first century, not walk away from them. We need to fortify the military's "thin green line" around the world by adding to the U.S. Special Forces and the Marines, and by expanding the U.S. army by 100,000 more troops. (An even bigger military for the world's most powerful armed forces, a very militaristic view of the way to handle the conflicts among nations. What uses does Emanuel have in mind for those troops?) We should give our troops a new GI Bill to come home to. (More material incentives to induce the financially strapped to sign up as cannon fodder.) Finally we must protect our homeland and civil liberties by creating a new domestic counterterrorism force like Britain's MI5. (A new domestic spying operation is an obvious threat to our civil liberties; MI5 holds secret files on one in 160 adults in Britain along with files on 53,000 organizations.)
But in some respects, Emanuel is a mysterious fellow, as evidenced by his biography, which is readily available on Wikipedia and in the piece in Fortune (3). But there are a few things missing or not fully explained. First, as is often pointed out, Emanuel's physician father was an Israeli émigré; but, according to Leon Hadar, he also worked during the 1940s with the notorious Irgun, which was labeled as a terrorist organization by the British authorities.(6) Perhaps Rahm's current interest in terrorism was first kindled at his father's Irgun knee.
Second, during the 1991 Gulf War, Emanuel was a civilian volunteer in Israel, "rust-proofing brakes on an army base in northern Israel." (Wikipedia, New Republic). This is peculiar on two counts. Here the U.S. goes to war with Iraq, but Emanuel, a U.S. citizen, volunteers not for his country, but for Israel. Moreover, here is a well-connected Illinois political figure with a father who had been in the Irgun, but he is assigned to "rust-proof brakes" on "an army base." Maybe.
Third, immediately upon his return from his desert sojourn, Emanuel at once became a major figure in the Clinton campaign "who wowed the team from the start, opening a spigot on needed campaign funds."(3) How did he do that after being isolated overseas, and with no experience in national politics? Fourth, after leaving the Clinton White House, he decided that he needed some accumulated wealth and "security" if he were to stay in politics. So he went to work for Bruce Wasserstein, a major Democratic donor and Wall Street financier. (Counter Punch)

What Trumps What in the White House? President Bush's hasty embrace of federal intervention in the Terri Schiavo case -- followed by yesterday's partial retreat -- has some folks trying to ascertain the relative importance to the White House of such factors as the "culture of life," state's rights, activist judges, the gun culture, global catastrophes and brute political calculation.
Here's how one reader put it in my Live Online discussion yesterday: "Now we learn that the Republicans have a trumping order of issues. Faith, Certainty and the Presidency of George W. Bush Bruce Bartlett, a domestic policy adviser to Ronald Reagan and a treasury official for the first President Bush, told me recently that ''if Bush wins, there will be a civil war in the Republican Party starting on Nov. 3.'' The nature of that conflict, as Bartlett sees it? Essentially, the same as the one raging across much of the world: a battle between modernists and fundamentalists, pragmatists and true believers, reason and religion.
''Just in the past few months,'' Bartlett said, ''I think a light has gone off for people who've spent time up close to Bush: that this instinct he's always talking about is this sort of weird, Messianic idea of what he thinks God has told him to do.'' Bartlett, a 53-year-old columnist and self-described libertarian Republican who has lately been a champion for traditional Republicans concerned about Bush's governance, went on to say: ''This is why George W. Bush is so clear-eyed about Al Qaeda and the Islamic fundamentalist enemy. He believes you have to kill them all. They can't be persuaded, that they're extremists, driven by a dark vision. He understands them, because he's just like them. . . .
''This is why he dispenses with people who confront him with inconvenient facts,'' Bartlett went on to say. ''He truly believes he's on a mission from God. Absolute faith like that overwhelms a need for analysis. The whole thing about faith is to believe things for which there is no empirical evidence.'' Bartlett paused, then said, ''But you can't run the world on faith.''
Forty democratic senators were gathered for a lunch in March just off the Senate floor. I was there as a guest speaker. Joe Biden was telling a story, a story about the president. ''I was in the Oval Office a few months after we swept into Baghdad,'' he began, ''and I was telling the president of my many concerns'' -- concerns about growing problems winning the peace, the explosive mix of Shiite and Sunni, the disbanding of the Iraqi Army and problems securing the oil fields. Bush, Biden recalled, just looked at him, unflappably sure that the United States was on the right course and that all was well. '''Mr. President,' I finally said, 'How can you be so sure when you know you don't know the facts?''' (New York Times)
Crimes Against Nature: Bush is sabotaging the laws that have protected America's environment for more than thirty years George W. Bush will go down in history as America's worst environmental president. In a ferocious three-year attack, the Bush administration has initiated more than 200 major rollbacks of America's environmental laws, weakening the protection of our country's air, water, public lands and wildlife. Cloaked in meticulously crafted language designed to deceive the public, the administration intends to eliminate the nation's most important environmental laws by the end of the year. Under the guidance of Republican pollster Frank Luntz, the Bush White House has actively hidden its anti-environmental program behind deceptive rhetoric, telegenic spokespeople, secrecy and the intimidation of scientists and bureaucrats. The Bush attack was not entirely unexpected. George W. Bush had the grimmest environmental record of any governor during his tenure in Texas. Texas became number one in air and water pollution and in the release of toxic chemicals. In his six years in Austin, he championed a short-term pollution-based prosperity, which enriched his political contributors and corporate cronies by lowering the quality of life for everyone else. Now President Bush is set to do the same to America. After three years, his policies are already bearing fruit, diminishing standards of living for millions of Americans.
I am angry both as a citizen and a father. Three of my sons have asthma, and I watch them struggle to breathe on bad-air days. And they're comparatively lucky: One in four African-American children in New York shares this affliction; their suffering is often unrelieved because they lack the insurance and high-quality health care that keep my sons alive. My kids are among the millions of Americans who cannot enjoy the seminal American experience of fishing locally with their dad and eating their catch. Most freshwater fish in New York and all in Connecticut are now under consumption advisories. A main source of mercury pollution in America, as well as asthma-provoking ozone and particulates, is the coal-burning power plants that President Bush recently excused from complying with the Clean Air Act.
