Amazon: tax effort is "unconstitutional" -- U.S. states may be eyeing budget deficits

Amazon.com Inc warned its 10,000-plus California sales affiliates on Wednesday that it may be forced to sever ties with them should the state begin taxing their online sales. The wealthiest U.S. state became the latest -- on the heels of Illinois and Connecticut -- to be dropped by Amazon from its nationwide sales-affiliate program, which relies on in-state websites to drive its own online business. Its affiliates, paid a fee when they funnel traffic to Amazon that results in a sale, have found themselves in the middle of a battle between Amazon and several states that argue the online retailer has a duty to collect sales taxes when those affiliates operate within their state.

5/7/2011 Nuclear Agency Is Criticized as Too Close to Its Industry
In the fall of 2007, workers at the Byron nuclear power plant in Illinois were using a wire brush to clean a badly corroded steel pipe — one in a series that circulate cooling water to essential emergency equipment — when something unexpected happened: the brush poked through. The resulting leak caused a 12-day shutdown of the two reactors for repairs. The plant’s owner, the Exelon Corporation, had long known that corrosion was thinning most of these pipes. But rather than fix them, it repeatedly lowered the minimum thickness it deemed safe. By the time the pipe broke, Exelon had declared that pipe walls just three-hundredths of an inch thick — less than one-tenth the original minimum thickness — would be good enough. Though no radioactive material was released, safety experts say that if enough pipes had ruptured during a reactor accident, the result could easily have been a nuclear catastrophe at a plant just 100 miles west of Chicago. Exelon’s risky decisions occurred under the noses of on-site inspectors from the federal Nuclear Regulatory Commission. No documented inspection of the pipes was made by anyone from the N.R.C. for at least the eight years preceding the leak, and the agency also failed to notice that Exelon kept lowering the acceptable standard, according to a subsequent investigation by the commission’s inspector general.

11/4/2010 The Citizens United Effect: 40 percent of outside money made possible by Supreme Court ruling
In 2002 former Defense Secretary Donald Rumsfeld once flippantly described connections between Saddam Hussein and Al Qaeda terrorists by saying, "There are known knowns; there are things we know that we know. There are known unknowns; that is to say, there are things that we now know we don’t know. But there are also unknown unknowns; there are things we do not know we don’t know." Little did Rumsfeld know that his remark would be the most accurate description for a murky midterm election eight years down the road. The 2010 midterm election is filled with both "known unknowns," outside groups raised and spent $126 million on elections without disclosing the source, and "unknown unknowns," we don't know what those undisclosed donors want. We do know one thing: the Supreme Court's Citizens United ruling allowed this election to be the costliest and least transparent midterm in recent history. The impact of Citizens United can be judged by simply following the money. The $126 million in undisclosed money represents more than a quarter of the total $450 million spent by outside groups. Add the $60 million spent by groups that were allowed to raise unlimited money, but still had to disclose, to the undisclosed money and the total amount of outside money made possible by the Citizens United ruling reaches $186 million or 40 percent of the total spent by outside groups.

9/29/2010 One in 28 US kids has a parent in prison: study
The US's exceptionally high rate of incarceration is causing economic damage not only to the people behind bars but to their children and taxpayers as a whole, a new study finds. The study (PDF) from the Pew Research Center's Economic Mobility Project, released Tuesday, reports that the US prison population has more than quadrupled since 1980, from 500,000 to 2.3 million, making the US's incarceration rate the highest in the world, beating former champions like Russia and South Africa. This means more than one in 100 Americans is in prison, and the cost of prisons to states now exceeds $50 billion per year, or one in every 15 state dollars spent -- a figure the study describes as "staggering." According to the authors, one in every 28 children in the US has a parent behind bars -- up from one in 125 just 25 years ago. This is significant, the study argues, because children of incarcerated parents are much likelier to struggle in life. A family with an incarcerated parent on average earns 22 percent less the year after the incarceration than it did the year before, the study finds. And children with parents in prison are significantly likelier to be expelled from school than others; 23 percent of students with jailed parents are expelled, compared to 4 percent for the general population.

Congress has passed the Wall Street Reform and Consumer Protection Act, but the task of transforming our economy into one of shared and sustainable prosperity has only just begun. Structural reform will come not through the sweep of a single piece of legislation but with new, innovative economic models that better reflect the democratic values of this country. The good news is that some of these transformative ideas are already taking root. Here are five ways to build a more just economy that Americans are experimenting with across the country. The answer is 'B' Corporations are compelled to pursue a single objective: maximize profit. In fact, a company can be sued for following goals that veer from that statutory obligation. That's why Maryland State Sen. Jamie Raskin sponsored the Benefit Corporation legislation that was signed into law this spring. It gives businesses the option to register as a "B corporation," an entity legally obligated to maximize both shareholder value and advance a common public purpose such as cleaner air, open space or affordable housing. The B corporation's stated public goal is vigorously monitored by independent, third-party groups. It's a new business model with social consciousness in its DNA. B corporation legislation has also been passed in Vermont, and it is being considered in New York, Pennsylvania, New Jersey, Oregon, Washington and Colorado.

Obama received the money from employees and their family members, making Goldman Sachs second only to the University of California as his biggest single source for donors in 2007 and 2008, according to the Center for Responsive Politics.

President Obama and his chief of staff Rahm Emanuel are lifetime members of the same gay bath house in uptown Chicago, according to informed sources in Chicago's gay community, as well as veteran political sources in the city. The bath house, Man's Country, caters to older white men and it has been in business for some 30 years and is known as one of uptown Chicago's "grand old bathhouses." WMR was told by sources who are familiar with the bath house that it provides lifetime memberships to paying customers and that the club's computerized files, and pre-computer paper files, include membership information for both Obama and Emanuel. However, sources close to "Man's Country" believe the U.S. Secret Service has purged the computer and filing cabinet files of the membership data on Obama and Emanuel. Members of Man's Country are also issued club identification cards. WMR learned that Obama and Emanuel possessed the ID cards, which were required for entry. Obama began frequenting Man's Country in the mid-1990s, during the time he transitioned from a lecturer at the University of Chicago Law School to his election as an Illinois State Senator in 1996. Emanuel, reportedly joined Man's Country after he left the Clinton White House and moved back to Chicago in 1998, joining the investment firm of Wasserstein Perella and maintaining his membership during his 2002 campaign for the U.S. 5th District House seat vacated by Rod Blagojevich, who was elected governor.

Sunshine Best immigrated to Chicago with no American credit history, little spare cash and a decidedly unglamorous digestive disorder. In short, she was no bank’s dream candidate for a small-business loan. Not helping matters was that the business in question was a bakery that would exist only online, and exclusively sell desserts made without gluten, an elastic protein found in wheat and completely indigestible for Best and others who suffer from Celiac disease. After being turned away by bank after bank, Best resigned herself to a grim routine of working two jobs and racking up credit card debt. Then a friend told her about a low-interest credit builder loan being offered by an organization called Accion Chicago. Two years and one $1,000 Accion loan later, Rise & Shine Desserts is a flourishing small business specializing in gourmet gluten-free treats. A former computer programmer raised in Toronto by parents who emigrated from Barbados, Sunshine Best isn’t exactly the type of person Nobel Peace Prize-winning microcredit pioneer Muhammad Yunus had in mind when he began, in the 1970s, to lend small sums of money to poor women in Bangladesh. But these days, Best’s one-woman enterprise represents not only a piece of the multi-billion dollar international microfinance market, but a critical part of what urban economic development is shaping up to look like in President Barack Obama’s America. Widely recognized as one of the 20th century’s most powerful innovations, microcredit is the practice of extending small loans at low interest rates to poor entrepreneurs who generally live in the developing world and lack access to conventional bank loans. By lending a beggar as little as $10 to buy, for instance, a loom to make textiles or a cow to make milk, microcredit bankers like Yunus are revolutionizing the way poor people, especially women, sustain themselves in some of the world’s hungriest places.

Jubilation was heard in Tel Aviv as Haaretz, the Israeli daily, boasted November 6th: "Obama kick-starts transition, picks Israeli Rahm Emanuel as chief of staff." Best known for his fundraising prowess among wealthy Jewish Democrats, the naming of Emanuel as the first presidential appointment echoes Sarah Palin's famous one-liner, "I love Israel." That claim was voiced in her vice-presidential debate with Joe Biden who is featured on a YouTube video famously proclaiming, "I am a Zionist." In sharp contrast to Obama's claim that the invasion of Iraq was a mistake, Emanuel claims he would do it again today. As chair of the Democratic Congressional Campaign Committee, he directed party funds to pro-invasion candidates and recruited candidates to oppose anti-war Democrats. Known in Washington as an outspoken pro-Israel hardliner, he joins Speaker Nancy Pelosi in bringing to the Middle East peace process a record of support for Tel Aviv's targeted assassinations of Palestinian political leaders. 4/5/2008 Come, O Come, Emanuel: It ain't over till it's over. But at some point soon, someone may have to not-so-gently tell Hillary time is up. Enter 'Rahmbo.'
Rahm Emanuel has been described as a street fighter with a killer instinct—as explosive, profane, wired and ruthless—sometimes as a compliment, sometimes not. But no one has ever cast him in the role of elder statesman, at least up until now. Emanuel, a 48-year-old congressman who grew up, somewhat weirdly, to study ballet and practice Chicago politics, has generally adapted to his situation in a combative, not diplomatic, manner. As an indifferent high-school student, he badly cut his finger on the beef-slicing machine at Arby's. That night, after his high-school prom, he jumped into Lake Michigan. The tip of his finger became infected and he nearly died. Ever since, Emanuel has relished raising his hacked-off middle figure at his foes. In conversation with almost anyone about anything, Emanuel uses the F word like a sergeant in a World War II motor pool. Emanuel would never be confused with Averell Harriman, who, in a gentlemanly way, stood up to presidents from FDR to LBJ. Still, someone may have to deliver the bad news. When the Judiciary Committee of the House of Representatives voted articles of impeachment against Richard Nixon in the summer of 1974, it fell to the GOP's grand old man, Barry Goldwater, to go to the president and say, "Mr. President, this isn't pleasant, but you want to know the situation and it isn't good." Goldwater told Nixon that there were, at most, 18 votes to acquit in the Senate—and then twisted the knife by saying that he himself was undecided.

Last week in CounterPunch (1), I wrote that the chair of the Democratic Congressional Campaign Committee (DCCC), Congressman Rahm Emanuel, had worked hard to guarantee that Democratic candidates in key toss-up House races were pro-war. In this he was largely successful, because of the money he commands and the celebrity politicians who reliably respond to his call, ensuring that 20 of the 22 Democratic candidates in these districts are pro-war. So the fix is in for the coming elections.

"A New Strategy to Win the War on Terror" ("War on Terror," as George Soros points out, is a false metaphor used by those who would drag us into military adventures not in our interest or that of humanity.) "We need to use all the roots of American power to make our country safe. (He begins by playing on fear.) America must lead the world's fight against the spread of evil and totalitarianism, but we must stop trying to win that battle on our own. (Messianic imperialism.) We should reform and strengthen multilateral institutions for the twenty-first century, not walk away from them. We need to fortify the military's "thin green line" around the world by adding to the U.S. Special Forces and the Marines, and by expanding the U.S. army by 100,000 more troops. (An even bigger military for the world's most powerful armed forces, a very militaristic view of the way to handle the conflicts among nations. What uses does Emanuel have in mind for those troops?) We should give our troops a new GI Bill to come home to. (More material incentives to induce the financially strapped to sign up as cannon fodder.) Finally we must protect our homeland and civil liberties by creating a new domestic counterterrorism force like Britain's MI5. (A new domestic spying operation is an obvious threat to our civil liberties; MI5 holds secret files on one in 160 adults in Britain along with files on 53,000 organizations.)

But in some respects, Emanuel is a mysterious fellow, as evidenced by his biography, which is readily available on Wikipedia and in the piece in Fortune (3). But there are a few things missing or not fully explained. First, as is often pointed out, Emanuel's physician father was an Israeli émigré; but, according to Leon Hadar, he also worked during the 1940s with the notorious Irgun, which was labeled as a terrorist organization by the British authorities.(6) Perhaps Rahm's current interest in terrorism was first kindled at his father's Irgun knee. Second, during the 1991 Gulf War, Emanuel was a civilian volunteer in Israel, "rust-proofing brakes on an army base in northern Israel." (Wikipedia, New Republic). This is peculiar on two counts. Here the U.S. goes to war with Iraq, but Emanuel, a U.S. citizen, volunteers not for his country, but for Israel. Moreover, here is a well-connected Illinois political figure with a father who had been in the Irgun, but he is assigned to "rust-proof brakes" on "an army base." Maybe. Third, immediately upon his return from his desert sojourn, Emanuel at once became a major figure in the Clinton campaign "who wowed the team from the start, opening a spigot on needed campaign funds."(3) How did he do that after being isolated overseas, and with no experience in national politics? Fourth, after leaving the Clinton White House, he decided that he needed some accumulated wealth and "security" if he were to stay in politics. So he went to work for Bruce Wasserstein, a major Democratic donor and Wall Street financier.
